It binds all current and future property owners to pay special fees and assessments to the Central Arizona Groundwater Replenishment District (CAWCD) to secure the subdivision's assured water supply. The document only covers water-related financial obligations and liens.
- Replenishment Assessment: Every parcel (each separate tax lot) is subject to an annual Replenishment Assessment levied by CAWCD based on the parcel's groundwater use. If unpaid, it becomes a continuing lien on the property and a personal obligation of the owner at the time it came due.
- Activation Fee: A one-time Activation Fee must be paid to CAWCD before a public report is issued allowing sale or lease of subdivided land. The fee equals a per-unit rate set by CAWCD multiplied by the total number of housing units on the parcel.
- Replenishment Reserve Fee: A fee equal to twice the Replenishment Reserve Charge times the projected annual excess groundwater demand for Ventana Picachos. It must be paid prior to issuance of a public report for subdivided lands (or long-term storage credits may be assigned instead). This article does not apply to parcels that qualify as Category 2 member land.
- Lien & Personal Obligation: Failure to pay the Replenishment Assessment, Activation Fee, or Replenishment Reserve Fee creates a continuing lien on the parcel and a personal obligation of the owner. CAWCD has rights and remedies under Arizona law, including interest, costs, and penalties.
- Amendments: This declaration may be amended only by written agreement of CAWCD, the Arizona Department of Water Resources, and owners of 67% of the total area of the property, or by changes in applicable statutes or regulations.
