Villa Del Valle Verados is a condominium community in Phoenix, AZ — you own your individual apartment unit and share ownership of common areas and facilities. The Homeowners Association maintains common elements, enforces rules, and levies assessments on each unit. These governing documents apply to all unit owners.
- What you own & maintain: You own your apartment unit and are responsible for exterior maintenance and upkeep except painting and decorating, which are the Association's responsibility. The Association maintains common areas including recreational facilities, pool, streets, and utilities.
- Assessments & fees: Annual assessments are set at the annual meeting. The board may increase them up to 10% per year without a membership vote. Any increase above 10% requires a 2/3 vote of members present or by proxy. Special assessments for capital improvements also require 2/3 approval. Delinquent assessments bear 18% annual interest and the Association may foreclose its lien.
- Pets: As of March 1, 1986, no animals of any description are allowed on the grounds or in any unit. The Executive Committee may grant a 30-day stay or yearly permission for existing tenants, with conditions (leash, cleanup). This privilege may be revoked with 5 days' written notice.
- Architectural review: No exterior improvements, alterations, or color changes may be made without written approval from the Board or its Architectural Control Committee. Plans must be submitted showing construction details. If not approved or disapproved within 30 days, approval is deemed given. The basic exterior color must be off-white, with trim colors from an approved palette.
- Use restrictions: No business, professional, commercial, religious, or institutional use is allowed on any lot. No signs larger than 9" x 30" are permitted, except a temporary 'for rent' or 'for sale' sign up to 5 square feet. No noxious or offensive activity is permitted.
- Common areas & amenities: Members have the right to use common areas and facilities, including a swimming pool and recreation hall. The Association may suspend usage rights for non-payment of assessments or for rule violations (up to 10 days).
