What Pima Inn Condominiums's governing documents say
This is a First Amendment to the Pima Inn Condominiums declaration, which modifies the original rules and establishes a connection to an adjacent hotel complex (Parcel 1). The condominium has 40 units in Phase II, and each unit can function as either one or two separate rental dwellings. Owners may rent on a daily, weekly, monthly, or annual basis, making short-term stays possible. The community is governed by the Arizona Condominium Act.
- Leasing & rentals: Units may be rented daily, weekly, monthly, or annually. Each unit can operate as a single dwelling or as two separate rental units. Lessees have the same common-area and Parcel 1 amenity rights as owners.
- Parking & vehicles: Each unit receives two parking spaces in the 'Condominium Parking' (one covered, one uncovered) per the REMA. Vehicle restrictions apply, but the Board (with Parcel 1 owner's consent) may make exceptions if space allows.
- Hotel relationship & REMA: The condominium is linked to a hotel complex on Parcel 1 via a Reciprocal Easement and Management Agreement (REMA). The Association must pay sums due under the REMA, and Parcel 1's owner retains certain rights, such as sign approval and enforcement of the declaration regarding the REMA.
- Signs & architectural review: Exterior signs require approval from both the Board and the owner of Parcel 1. The Architectural Control Committee (appointed by the Board) oversees changes, and committee members may also be association directors or officers.
- Insurance: The Association carries master hazard insurance (may include personal property in units at Board's option). Each owner must insure their own personal property not covered by the master policy. Personal liability coverage is increased to at least $1,000,000 per occurrence.
- Assessments & phasing: Assessments are generally allocated per unit, but if costs differ significantly between phases, the Board may adjust assessments on a phase-by-phase basis. Recreational common area costs are always spread across all units.
- Declarant control & voting: Declarant (or its successor) holds class B membership with three votes per owned unit until 75% of units are sold to non-declarant owners or four years after sales cease, whichever comes first. During control, Declarant appoints officers and directors.
- Reconstruction & condemnation: If the property is substantially damaged, the Association must rebuild (unless Parcel 1 owner waives). Condemnation awards may be distributed instead of rebuilding if 75% of voting power agrees and Parcel 1 owner consents (while REMA is in effect).
