What Sands Scottsdale Townhouses One and Two's governing documents say
This is the governing document for Sands Scottsdale Townhouses One and Two, a townhome community in Scottsdale, Arizona, with party walls and shared common areas. It creates a homeowners association (HOA) that binds all owners of the 132 townhouse lots, and also references a separate Master Association (Sands Scottsdale Home Owners Association) with its own assessments and rules. The document covers property rights, maintenance responsibilities, use restrictions, and architectural control.
- Party walls: Walls on lot dividing lines are party walls. Owners must share repair costs if damage is from a common cause; if one owner's act causes damage, that owner bears full cost. Any modification to a party wall requires written consent of the adjoining owner.
- Leasing & rentals: A lot and its improvements may only be rented as a whole to a single family (defined as persons related by blood/marriage/adoption, or up to three unrelated persons sharing a household). No portion of a lot may be rented separately.
- Pets: Only commonly accepted household pets are allowed, not for commercial purposes. Dogs and cats must be leashed and not allowed to roam freely. Feeding wild animals (except hummingbirds) is prohibited.
- Vehicles & parking: No trucks (including pickup trucks), buses, trailers, boats, campers, or similar vehicles may be kept on any lot. These must be stored in the Association's designated storage area (Tracts L and N). Carports cannot store recreational equipment, bicycles, motorcycles, etc. Go-carts, motorized skateboards, mopeds, and unlicensed motorized vehicles may not be used on streets or sidewalks.
- Architectural review: All exterior improvements, additions, or alterations (including fences, walls, and landscaping changes visible from the street) require prior written approval from the Board of Directors. If no decision is made within 30 days of submission, approval is deemed given.
- Assessments & fees: Each lot pays annual and special assessments at a uniform rate (1/132 of total). The initial maximum annual assessment was $780 per lot, which can increase up to 5% per year without member vote; larger increases require approval of 2/3 of votes cast at a meeting with at least 60% quorum. Delinquent assessments bear interest at prime plus 2% per annum and become a lien on the property.
- Maintenance responsibilities: The Association maintains the common areas and the exteriors of townhouses (including paint, trees, shrubs, landscaping visible from the street, and front yard irrigation). Owners maintain interiors, exterior doors, windows, awnings, roofs, driveways, sidewalks perpendicular to the street, and any private patios or yard area not maintained by the Association.
- Business & signs: No business may be conducted on a lot unless it is not visible or audible from outside, complies with zoning, involves no customer visits or on-street parking, and is consistent with residential character. One 'for rent' or 'for sale' sign of up to 5 square feet is allowed temporarily. Other signs are prohibited except for name/address or security signs up to 9'' x 30''.
