Tierra (Tierra Palmas Townhouses) is a planned community of attached townhomes in Queen Creek, AZ. This Declaration of Covenants, Conditions and Restrictions (CC&Rs) establishes a homeowners association (HOA) that all lot owners automatically join. The rules cover property rights, assessments, architectural control, use restrictions, maintenance, and enforcement.
- Assessments & fees: Annual assessments are levied on all lots. The maximum annual assessment can increase up to 25% per year without a membership vote. Special assessments for capital improvements may be levied with approval of one-half of voting members. Assessments are a lien on the property and a personal obligation of the owner.
- Architectural review: No building, fence, wall, or other structure may be erected, nor exterior alterations made, without prior written approval of the Board or an Architectural Committee. Plans must show nature, color, shape, height, materials, and location.
- Pets & animals: No livestock, poultry, rabbits, or rodents. Only commonly accepted household pets, not exceeding one in number, may be kept without Board consent. Owners are responsible for cleaning up after pets, and pets must not be loose on common areas.
- Leasing & rentals: A lot may be rented only in its entirety and only to a single family. No short-term or partial rentals are mentioned; terms must comply with this single-family restriction.
- Vehicles & parking: Vehicles and equipment may not be parked in yards or undesignated areas except for persons doing work (daylight hours) or emergencies.
