Scottsdale Club Villas is a 94-unit condominium in Scottsdale, AZ — you own your unit and share the common elements (building exteriors, grounds, pool, spa, parking, etc.) with all other owners, and the association manages and insures the common areas. This declaration binds every unit owner and occupant. Units are intended for resort or short-term vacation lodging, not as permanent residences, and the developer (Declarant) retains special rights to use units for rentals and timeshare sales.
- What you own & maintain: You own the interior of your unit (walls, floors, fixtures, appliances, interior doors, windows, and screens). You must maintain the interior, hot water heater, HVAC inside the unit, electrical/plumbing within your unit, and your balcony/patio and the exterior surfaces of your entry door. The association maintains all exteriors, roofs, structural elements, sidewalks, parking lots, swimming pools, tennis courts, and the Guest Services Building.
- Leasing & rentals: Units may be leased for short-term occupancy or transient lodging — there is no minimum lease length. Leases must be in writing on a standard form prescribed by the board, and the lessee must comply with all governing documents. Only the Declarant or the association may show a unit for sale or rent without prior notice.
- Pets: No pets are allowed unless permitted by the association's rules and regulations. At most, the rules may allow up to two of the following: a small dog or cat, a small bird cage, a small fish tank, or an assistance animal. No animals may be bred or kept on common elements.
- Parking & vehicles: Each unit is allocated one uncovered parking space (assigned by the association). No trucks over 2-ton capacity, no campers, boats, trailers, or inoperable vehicles may be parked on the property. Only pickup trucks with camper shells under 7 ft. height and mini-motor homes under 7 ft. height and 18 ft. length are allowed if used for regular transportation. No vehicle repairs or storage of abandoned vehicles on the property.
- Use restrictions: Units may be used only for resort accommodation or residential purposes (or transient vacation lodging if in a timeshare plan). No commercial use is allowed except by the Declarant for sales, marketing, or rental. No loud or offensive activities, no open fires, no outdoor clotheslines, no exterior antennas, no signs (except Declarant or association), and no home businesses.
- Architectural control & alterations: No owner may alter the exterior of the building (roof, paint, walls, fences) — the association handles all exterior painting and repairs. Interior alterations are allowed but must not affect structural elements or common elements. The association must approve any changes to exterior decor, furniture, or fixtures if they were provided by Declarant or the association.
- Assessments & fees: Each unit pays a share of common expenses (general and special assessments) based on a uniform rate (1/94th initially). Delinquent assessments create a lien on the unit. The board may suspend voting rights for nonpayment after 30 days.
