What The Pavilions's governing documents say
The Pavilions is a 134-unit condominium community in Scottsdale, AZ, part of the larger Gainey Ranch master-planned development. You own your individual unit (airspace) and an undivided 1/134 interest in the common elements. The community is governed by this Declaration, the Master CC&R, and the Council of Co-Owners. This document defines property rights, use restrictions, and assessment obligations.
- What you own & maintain: You own the airspace within your unit (finished boundaries), including interior surfaces and appliances, but not structural parts, bearing walls, or utility lines. You have exclusive use of an assigned two-car garage, a patio/deck, and mailbox. The association maintains all common elements.
- Residential use only: Units must be used exclusively as residences. No business, trade, or professional activity is allowed, except for leasing, promotional sales by the declarant, or use as a model/office by the association or declarant.
- Pets: Only domestic dogs, cats, fish, and caged birds are allowed, with a maximum of two total from any combination. Animals must be leashed outdoors and not create nuisances. Outdoor structures for animals are prohibited. A $50 cleanup fee may be assessed for unsanitary conditions.
- Parking & vehicles: Each unit has an assigned two-car garage and garage approach. No vehicle may be parked on the garage approach for more than 24 consecutive hours. Other uncovered parking is for guest use only. Recreation vehicles (campers, motor homes, boats) are prohibited.
- Assessments & fees: Annual assessments are set uniformly per unit and collected monthly. Until May 31 of the year following the first unit sale, the monthly assessment cannot exceed $125. Special assessments for capital improvements require a 2/3 vote. Late payments incur 18% interest and potential lien foreclosure. A transfer fee of $50 (adjustable by the board) applies upon sale.
- Leasing & rentals: Leasing is permitted, subject to all provisions of the Declaration. No minimum lease term is specified in this document. Leases must comply with any Master Association rules.
- Exterior alterations & antennas: No exterior changes or improvements may be made without prior written approval from the Master Architectural Committee and the board. Antennas or outdoor transmission devices are generally prohibited unless approved. All utility lines must be underground or concealed.
