Villa D'Este is a single-family home subdivision in Phoenix, AZ, governed by the Villa D'Este Improvement Association (HOA). These recorded CC&Rs run with the land and apply to all lot owners. The HOA maintains a common area (Tract A) and enforces rules on land use, building, and aesthetics.
- Land use & businesses: All lots are for residential use only. No business activities of any kind are allowed on the premises. Dwellings must be high-class single-family homes or apartments.
- Pets: Household pets are permitted, but no animals, livestock, or poultry may be kept on the premises.
- Signs: Only one "For Sale" or "For Rent" sign per lot is allowed. No commercial signs, billboards, or other business advertising are permitted.

- Assessments & fees: Annual assessments are levied per lot to cover maintenance of Tract A and reserves. The total annual assessment per lot cannot exceed $300 unless owners of at least 75% of lots consent. Invoices are due within 10 days; unpaid amounts become a lien enforceable as a materialmen's lien.
- Leasing & rentals: All sales, leases, or transfers require notice to the HOA Board, which has 15 days to approve or exercise a right of first refusal. If disapproved but the option is not exercised, the transfer must include either Board approval, an affidavit of notice and failure to act, or written approval from owners of at least half the lots.
- Party walls: Walls built on lot dividing lines are party walls. Each adjacent owner shares repair and maintenance costs. Damage caused by one owner must be repaired at that owner's expense; damage from other causes is shared equally. Modifications to party walls require written consent from the adjoining owner and Board approval. Disputes are settled by arbitration.
