Newport Heights (also known as Prescott Summit) is a single-family home subdivision in Prescott, AZ, governed by a homeowners association (the Prescott Summit Association). The declaration applies to homeowners (lot owners) and sets rules for residential use, construction standards, maintenance, and assessments.
- Residential use & construction: Each lot is limited to one single-family detached residence. Minimum floor area is 1,600 sq ft for lots 82–117 and 1,200 sq ft for lots 1–81. Modular or manufactured homes are not permitted, but manufactured components may be used. Exterior construction must be completed within six months of permit issuance.
- Animals & pets: No more than two domestic animals per residence. In a later section, the document also says no more than four adult dogs and four adult cats per residence (creating an inconsistency; both provisions appear). Exotic animals are not allowed except as family pets. Animals must be fenced or leashed.
- Parking & vehicles: Parking overnight on streets is prohibited. Vehicles must be kept in garages or driveways. - Architectural control: Any exterior construction, alteration, or landscaping (including fences, walls, sheds, antennas, solar panels, and outside lighting) requires prior written approval from the Architectural Committee (or Board). Plans are reviewed for harmony with surrounding structures. The committee may charge a reasonable fee and must approve or disapprove within 30 days.
- Assessments & fees: The association levies annual assessments and may levy special assessments for capital improvements (approved by majority vote). Assessments are at a uniform rate per lot. Unpaid assessments bear 12% annual interest and become a lien on the lot. Declarant is exempt from assessments but must contribute labor, materials, or funds up to the normal lot assessment if needed.
