What Royal Oaks Plat II's governing documents say
Royal Oaks is a single-family home subdivision in Prescott, AZ, governed by a recorded Declaration of Restrictions (CC&Rs) that run with the land. These rules apply to all lot owners and their tenants, and are enforced by other lot owners, not an HOA.
- Land use & building type: Lots may only be used for residential purposes. Only one detached single-family dwelling (max 2 stories or 30 feet) and a private garage are allowed. No business, trade, manufacturing, hospital, or sanitarium. Ham radio towers are prohibited. Designated lots (56-62, 65-87, 92-95) are restricted to new luxury double-wide manufactured homes meeting specific specifications.
- Architectural review: All buildings, fences, and alterations require prior written approval from the Architectural Control Committee (initially William A. Gary, Marion Gary, Swayze McCraine). Plans must be submitted; if no response within 30 days and no lawsuit filed, approval is deemed given. The committee reviews quality, harmony of design, and location.
- Setbacks & fences: Buildings must be at least 40 feet from front and rear property lines, 20 feet from side lines (25 feet on corner lots). Fences and walls cannot exceed 6 feet on rear or side lines, and 4 feet within front or side street setbacks. All fences require committee approval.
- Livestock & pets: No poultry or fowl. Dogs, cats, and other household pets are allowed but not for commercial purposes. Horses or 4-H animal projects may be kept only on lots 63, 64, and 65-77, with pipe, sucker rod, or chain-link fencing and committee-approved barns/stables.
- Parking & vehicles: No overnight parking of trucks, pickup trucks, or trailers on the street. Only passenger cars and pickup trucks may be parked in open carports. No repair or maintenance work on vehicles except inside a garage. Abandoned or inoperable vehicles must not be visible. RVs, boats, bikes must be parked behind the rear line of the house.
- Water use & irrigation: Lot owners automatically become members of Granite Oaks Water Users Association with one vote upon connection. A refundable meter charge and additional connection costs apply. Irrigation is limited to 9,000 square feet per lot.
- Term & enforcement: The covenants run for 25 years from January 6, 1993, and automatically renew for successive 10-year periods unless a majority of lot owners amend or revoke. Any lot owner can sue to enforce or recover damages for violations.
- What this document doesn't cover: This document does not create an HOA, impose regular assessments or dues, restrict leasing (no minimum lease term), or specify age restrictions. It is a declaration of restrictions recorded for the subdivision.

- The floor area of the dwelling, exclusive of porches, garages, carport and patios, shall be not less than 1,200 square feet unless otherwise approved by the Committee. (Section 3)
