Shadow Valley Estates is a single-family residential subdivision in Prescott, AZ, governed by a Declaration of Covenants, Conditions, and Restrictions (CC&Rs) that run with the land and bind all lot owners. The rules focus on maintaining a natural, upscale character through strict architectural review, minimum home sizes, and limitations on vehicles, animals, and uses. There is no homeowners' association or common area; an Architectural Control Committee enforces the design standards.
- Architectural & Landscape Review: Any building, fence, wall, structure, or exterior alteration, including painting, landscaping, and tree removal, requires prior written approval from the Architectural Control Committee. Plans must show design, materials, colors, site location, grading, and tree preservation. The committee can reject plans for aesthetic incompatibility. If no decision within 30 days, approval is deemed given.
- Minimum Home Sizes & Setbacks: Single-level homes must be at least 1,700 sq ft; two-story homes at least 1,200 sq ft on main level; 1.5-story homes at least 1,200 sq ft on first floor and 1,700 sq ft total. Maximum building height is 2 stories (30 ft). Minimum lot area is 35,000 sq ft. Front setback is 30 ft; corner lots have a 20 ft side setback; rear yard at least 30 ft. Main building plus accessory cannot cover more than 30% of lot.
- Use & Occupancy Restrictions: Lots are for single-family residential use only, occupied by the owner, family, or guests. No temporary structures (motor homes, trailers, tents, etc.) may be used for habitation. No noxious or offensive activities. Laundry cannot be outdoors. No lot may be divided into smaller parcels.
- Vehicles & Parking: Each dwelling must have an attached 2-stall garage and paved off-street parking for at least 2 additional vehicles. No vehicle over 6,500 lbs, commercial vehicles, boats, trailers, RVs, or campers may be parked on the lot unless fully enclosed in a garage. Motorcycles, mopeds, etc. may only be operated on private roads with mufflers. No vehicle repair outside a garage. Disabled vehicles must be stored in garage or removed.
- Animals: No livestock, poultry, or reptiles may be raised or kept. Dogs, cats, or other household pets are allowed subject to rules adopted by the Board (but no specific pet limit or breed restriction stated).
- Signs, Garbage & Exterior Lighting: No signs without committee approval except one 'For Sale' or 'For Rent' sign, removed within 7 days. Trash must be in sanitary containers, stored out of sight, placed curbside no more than 12 hours before collection. Spotlights and floodlights must not disturb neighbors. No exterior antennas or flagpoles without approval.
- Street Lights & Term: Each lot owner must install and maintain a street light of a committee-approved model, illuminated dusk to dawn at owner's expense. The covenants run for 35 years from 1992, automatically renewing for successive 10-year periods unless amended by majority of lot owners.
