This document creates the Quail Creek Villas Association, a sub-association within the master-planned Quail Creek Country Club community in Queen Creek, AZ. It applies to owners of specific villas lots (attached homes) and works alongside the master declaration, which also binds all owners. The Villas Association handles exterior maintenance, landscaping, and common areas for these lots, while owners are responsible for interiors and structural elements except roofs.
- What you own & maintain: You own your villa lot and the home on it. The Villas Association maintains the roof, exterior surfaces, exterior glass, landscaping (front, side, back yards), sprinkler systems, driveways, and parking areas on your lot. You are responsible for interior surfaces, cabinetry, countertops, plumbing fixtures, lighting, personal property, HVAC units, and all structural repairs except the roof. You cannot alter the exterior (paint, landscaping, etc.) without Villas Association approval.
- Architectural review: No building, fence, wall, exterior landscaping, painting, roof replacement, or other alteration that changes the exterior appearance of your lot or home may be done without prior written approval from the Villas Board (or Declarant before transition). Plans must be submitted, and a review fee may be charged. Approvals consider harmony with surrounding structures and the community's uniform look.
- Assessments: You must pay monthly assessments to the Villas Association. The maximum annual assessment in 2014 was $135/month, increasing by up to 10% each year (compounded). Assessments are due by the 1st of each month; late charges (up to 25% of the delinquent amount) and 18% annual interest apply. Additionally, you are liable for separate assessments under the Master Declaration for the larger community.
- Insurance: The Villas Association carries property insurance on the villas lots and common areas (excluding owner-installed improvements and personal property) and general liability insurance ($1M minimum). Owners should obtain their own insurance for interior finishes, cabinetry, countertops, fixtures, and personal property. Insurance proceeds are held by the association for repairs; owners waive claims against the association for damages covered by the association's policy.
- Easements & access: The Villas Association and Declarant have an easement over your lot (not inside your home) to inspect, maintain, repair, and replace landscaping, irrigation, roofs, exterior surfaces, and to perform construction or warranty work. For work inside your home, they may request access with reasonable notice.
- Community structure & developer control: The Villas Association is a sub-association within Quail Creek Country Club. Until the 'Villas Transition Date' (after all lots sold or at Declarant's sole discretion), Declarant controls the Villas Board and has 3 votes per lot it owns. Owners have only 1 vote per lot after transition. Declarant may annex additional property and amend the declaration with 51% owner consent after transition.
