This is a set of governing documents for the Sun Valley Farms Irrigation Association Unit II, an agricultural irrigation association in Queen Creek, AZ. It is not a residential homeowners association; members are owners of irrigated parcels who collectively use Central Arizona Project water for agricultural purposes. The rules bind all parcel owners and govern membership, irrigation management, and association governance.
- Membership & agricultural requirement: The association is limited to no more than 25 members. All members collectively must produce $5,000 in gross annual sales of agricultural commodities or livestock. Each parcel has an equal share in meeting this requirement, and members are reimbursed their contributed sales minus an annual maintenance fee.
- Board of Directors & responsibilities: The owners elect a Board of at least three members, each a property owner. One director serves as contact for the Queen Creek Irrigation District and Bureau of Reclamation; one manages the checking account, sales records, and annual BOR submission; and one keeps meeting minutes and notifies members of association business.
- Irrigation payment & scheduling: Parcel owners pay for their individual monthly CAP water usage. Full payment must be received by the board contact before scheduling additional water delivery. No water is delivered to delinquent parcels. Scheduling (delivery or cancellation) must be submitted to Queen Creek Irrigation District at least 24 hours in advance.
- Liability & binding effect: The association as a whole is liable for legal actions; no single member or director is held solely liable. The declaration runs with the land and binds all current and future owners, successors, and assigns.
- What this document doesn't cover: These documents do not cover typical residential HOA rules such as architectural restrictions, pet limits, parking, or leasing terms; those may be addressed in separate CC&Rs for a residential subdivision. The amendment document (DOC 68044) pertains to a different unit (Sun Valley Farms Unit V) and only records votes on amendments to that unit's CC&Rs.
