What Circle Cross Ra's governing documents say
This is a commercial restrictive covenant for Circle Cross Ranch Retail Center. It does not apply to residential homeowners or renters. It restricts hamburger sales on certain commercial lots to protect a Burger King on adjacent property.
- Hamburger sales restriction: No owner or occupant of the burdened commercial lots may generate more than 20% of annual gross revenue from hamburger and hamburger derivative sales. This does not apply to Smith's Food & Drug or the specific tenants listed in Exhibit C.
- Who can enforce: Only the owner of the Kraf Property (the Burger King parcel) may enforce this covenant. Barclay and Fry's have no enforcement obligation or right.
- Termination conditions: The covenant terminates if the Burger King does not open within one year of recording (May 2008) or if it ceases operations for 180 consecutive days.
- Exempted tenants: Listed exempt tenants include Fry's, Fresh Cleaners, L&N Nails, Great Clips, Dragon Eye, Upscale Salon, Pizza Shop, Tanning Salon, Dentist, Subway, and Chase Bank. These are not subject to the hamburger restriction.
- What this document doesn't cover: This document does not contain any rules for residents, such as architectural guidelines, parking, pets, or leasing restrictions. It is an ancillary commercial covenant that does not apply to residential properties in the Circle Cross Ranch community.
