This is a declaration of covenants for Red River Phase 1 - Province (a single-family subdivision in San Tan Valley, AZ) that imposes groundwater replenishment fees on each parcel as a condition of membership in the Central Arizona Groundwater Replenishment District. It is not a full set of community rules—it only concerns water-supply obligations and fee liens.
- Replenishment Assessment: Each parcel is subject to an annual Replenishment Assessment levied by CAWCD based on the parcel's Replenishment Obligation (the amount of excess groundwater used). This assessment is a lien on the parcel and a personal obligation of the owner.
- Activation Fee: A one-time Activation Fee must be paid to CAWCD before a public report is issued authorizing sale or lease of subdivided land within the owner's portion of the property. The fee amount is set by CAWCD per housing unit.
- Replenishment Reserve Fee: A Replenishment Reserve Fee applies to Category 1 member land (not Category 2). It must be paid prior to issuance of a public report, and can be satisfied with long-term storage credits if approved. This fee is also a lien.
- Lien for Nonpayment: If the Replenishment Assessment, Activation Fee, or Replenishment Reserve Fee is not paid when due, CAWCD obtains a lien on the parcel, plus interest, costs, and penalties as provided by law.
- Binding Effect: These covenants run with the land and bind all current and future owners. By accepting a deed or acquiring an interest in a parcel, each owner agrees to pay the fees and be subject to the declaration.
