What Alterra's governing documents say
This is a standard single-family homeowners association (HOA) community governed by the Master Declaration of Covenants, Conditions and Restrictions for Alterra in Ak-Chin Village, AZ. These rules bind all lot owners, residents, and their guests. Additional documents—a Tract Declaration for Parcels A & G and a groundwater replenishment declaration—impose supplementary rules and fees; consult those separately.
- Architectural review: No exterior improvements, alterations, or landscaping changes may be made without prior written approval from the Architectural Committee. This includes buildings, fences, colors, grading, and lighting. Declarant is exempt; Designated Builders receive expedited review.
- Pets & animals: Only a reasonable number of common household pets allowed. Pets must be kept in a fenced yard or on a leash, and owners must immediately remove droppings. No structure for animals may be visible from neighboring property. The Board determines what is reasonable and what constitutes a nuisance.
- Residential use & home businesses: Lots and residential units are exclusively for single-family residential use. Limited home businesses are permitted if they are not visible or audible outside the unit, comply with zoning, and do not involve door-to-door solicitation or create a nuisance.
- Signs: In addition to Master Declaration restrictions, the Tract Declaration for Parcels A & G limits 'for sale' signs to 5 square feet, and they cannot be displayed until one year after the lot is conveyed from the tract declarant. 'For rent' signs are prohibited until two years after conveyance.
- Landscaping & maintenance: Owners must maintain landscaping on their lot and adjacent rights-of-way, including keeping areas trimmed and free of weeds and debris. All landscaping and irrigation must maintain existing grade and drainage; plants must be at least 24 inches from residential units, and no plastic ground cover within 36 inches.
- Assessments & fees: The Association levies annual assessments and may levy special assessments. Assessments constitute a lien on the lot. The Association may suspend use of common areas for owners delinquent more than 15 days. A separate groundwater replenishment declaration imposes additional fees for water supply assurance.
- Parking & vehicles: Trucks, trailers, campers, and boats are restricted (see Articles 4.20–4.22). Parking must comply with Association rules; no overnight parking of certain vehicles may be permitted. Garage openings must be kept closed except for entry/exit.
- Easements & entry: The Association has easements over lots for inspection, maintenance, and emergency repairs. Utility easements exist across common areas and lots. Declarant and Designated Builders have additional easements for construction and sales purposes.
