Monte De Paz is a single-family home subdivision in Scottsdale, AZ. These covenants and restrictions (CC&Rs) run with the land and are binding on all lot owners until 2093. They cover minimum home sizes, architectural approvals, allowable pets, and a ban on businesses.
- Minimum dwelling size: Single-family homes must have a minimum ground floor area (excluding open porches, patios, carports, garages, and guest quarters) of 1,699 sq ft for 2 bedrooms, 2,009 sq ft for 3 bedrooms, 2,490 sq ft for 4 bedrooms, and 3,000 sq ft for 5 or more bedrooms.
- Architectural review: No structure, wall, or fence may be built without prior written approval of a committee—initially from officers of United National Development Corporation until 75% of lots are sold, then by a committee elected by a majority of owners. If the committee fails to act within 30 days of a written request, approval is not required, provided the building harmonizes with existing structures.
- Pets: Dogs, cats, and other household pets may be kept, but not bred, raised, or maintained for any commercial purpose.
- Business prohibition: No business of any kind may be conducted on or from any residential lot. A doctor's office in his home is excepted, but no hospital, sanitarium, theater, saloon, or other place of entertainment is allowed.
- Guest houses and outbuildings: One guest house or servants quarters (or combination) is allowed per lot, with design and location subject to architectural committee approval. No garage or outbuilding may be used for residence except for non-paying guests or actual servants.
- Utility easements: No structure shall be erected on the easements for public utilities as shown on the subdivision plat.
- Term and modification: These covenants run until January 1, 2093, and automatically renew for successive 10-year periods unless a majority of then-owners vote to change them in whole or in part.
