Encanto Norte is a single-family home community in Scottsdale, AZ governed by an HOA. This document is the full set of Covenants, Conditions, and Restrictions (CC&Rs) that bind all owners. It covers how you may use your lot, architectural rules, assessments, and more.
- Private residential use: Lots and dwellings must be used solely for private single-family residential purposes. No commercial activity, no manufactured or mobile homes, and no temporary structures (e.g., tents, trailers) are allowed.
- Architectural review: All exterior changes (new construction, fences, colors, landscaping, etc.) require prior written approval from the Architectural Control Committee (ACC). Homes must be at least 2,400 sq. ft. of air-conditioned living area, no more than one story, and overall height capped at 30 feet.
- Parking & vehicles: Each lot must have a minimum 2-car enclosed garage. No on-street parking for residents. Recreational vehicles, boats, commercial vehicles, and inoperable vehicles must not be visible from neighboring property and cannot be stored on lots.
- Leasing & rentals: Owners may lease their dwelling unit, but any lease must be in writing, for a term of at least 30 days, and a copy must be provided to the Association. The lease must require tenants to comply with all governing documents.
- Animals: No livestock or poultry. Generally no more than two pets per household, unless the Board determines otherwise. Dogs must be leashed when off-property, and owners must clean up after them.
- Assessments: Annual assessments fund common area maintenance and reserves. The initial maximum annual assessment was $800 (as of 2006). Increases are capped at 20% or the Consumer Price Index, whichever is greater; larger increases require a 2/3 owner vote. Assessments create a lien on the lot if unpaid.
