Neely Commons is a single-family home HOA in Scottsdale, AZ (Maricopa County). The rules bind all lot owners. The association maintains common areas and enforces use restrictions. Key limits: each lot is for one detached single-family residence (max 2 stories), no commercial activity except approved home businesses, and leasing requires a minimum 30-day term.
- Residential use & home businesses: Each lot must be used as a single-family residence. No commercial activity is allowed, but home businesses permitted if they comply with city ordinances. The Declarant may maintain sales offices and construction facilities.
- Building & lot standards: Only one detached single-family residence, not exceeding two stories, plus a 1–3 car garage. All buildings must be new construction; prefabricated structures are not allowed if visible from neighboring property. Landscaping must be installed within six months of purchase and kept weed-free.
- Signs: Only allowed signs: one temporary for-sale/rent sign (max 5 sq ft), one residential identification sign (max 80 sq in), signs required by law, and Architectural Committee–approved signs. Declarant’s advertising signs are also permitted.
- Vehicles & parking: Vehicles over 222'' length, 75'' height, or 84'' width are prohibited (includes most trucks, trailers, RVs, boats). Guest vehicles may park on a lot for only 7 days per 6-month period. No inoperable vehicles. Parking in front or side yards is prohibited; overnight street parking not allowed. Garages must be kept clean and used only for vehicles and household storage.
- Leasing & rentals: Leases must be in writing, for the entire residence and lot, with a minimum term of 30 days. Model homes and sales offices are exempt.
- Pets & animals: Common household pets (dogs, cats) are allowed but not for commercial breeding. No animals, insects, livestock, or poultry. Pets must be kept in a fenced yard or on a leash. No animal structures visible from neighboring property.
- Assessments & fees: Annual assessments are levied equally per lot. The initial maximum annual assessment was $27; it increases annually by the greater of 5% or CPI, up to 20% per year without owner vote. A transfer fee is paid by each new purchaser. The first purchaser also pays 2 months' assessments into a reserve account. Delinquent assessments incur 10% interest or a $15 late fee, and the Association may place a lien and foreclose.
- Architectural review: The Architectural Committee must approve external design changes, landscaping plans, HVAC and solar panels, signs, and any structures. The committee is appointed by Declarant initially.
