Orange Lake in Scottsdale is a timeshare resort in Scottsdale, AZ — you buy a fee simple undivided interest in the entire resort, not a specific unit, and get the right to reserve and occupy a unit for a use period each year through a points-based reservation system. This document is the governing declaration that binds all timeshare interest owners, who are members of the owners' association. The association maintains all units, common areas, and furnishings, and owners pay assessments for common expenses.
- What you own & maintain: You own an undivided fee simple interest in the entire resort as a tenant in common, not a specific unit. The association maintains all units, common furnishings, and common areas (including pools, hot tubs, lobby, etc.) and carries master insurance. Owners have no right to occupy a particular unit; they reserve a unit within their designated Building Type.
- Reservation system & use periods: Use is through a first-come, first-served reservation system. Reservations must be made 60–395 days before arrival for a 7-night stay (check-in Friday, Saturday, or Sunday). Unused points do not carry over. Owners must be current on all obligations to obtain a confirmation. If no reservation is made, the developer may rent the unit.
- Building types: There are two building types: Signature (higher-quality furnishings and services) and Standard. Owners can only reserve units within their assigned Building Type. Buildings 2 and 3 are Signature; others are Standard. Developer may re-designate types before any owner deed referencing that building is recorded.
- Pets: No pets, animals, livestock, or poultry are allowed in any unit or on the resort, except service animals as required by law.
- Commercial activity & leasing: No trade, business, or commercial activity may be conducted in any unit or with respect to a timeshare interest (including rental businesses or resales). Only the developer or its affiliates may rent unsold or unoccupied use periods. Owners may not rent their use period; only the developer may do so.
- Vehicles & parking: Vehicles must be parked in authorized areas. No boats, trailers, trucks over 20 feet, campers, or RVs are allowed without developer permission. No vehicle repairs except emergencies. Parking may be further regulated by rules.
- Occupancy & guests: Units are for personal transient resort occupancy only. Owners may authorize family or guests to occupy a unit. Check-in/check-out times and other procedures are set by the board. Holdover owners may be subject to penalties and removal.
- Exchange programs: Developer may affiliate the resort with exchange programs (e.g., Primary Exchange Company). Owners may choose to participate or not. Association cannot facilitate exchanges with non-designated programs.
