Pinion Plaza is a 55+ age-restricted condominium community in Scottsdale, AZ (Sun City Unit 40A). You own your individual unit and share ownership of common elements maintained by the association through monthly assessments. At least one resident per unit must be 55 or older; residents under 18 cannot occupy the property for more than 45 days per calendar year.
- Age restriction (55+): At least one occupant must be 55 or older. No one under 18 can reside there for more than 45 days per calendar year. The association may grant variances if at least 80% of units remain occupied by someone 55+, subject to age verification by affidavit.
- Leasing & rentals: You can only lease to immediate family members (children, parents, siblings, in-laws). Owners who were leasing as of December 7, 1999 may continue, but that right ends upon sale, owner death, or 12+ months without a lease. The Board can grant hardship variances. Leasing owners must notify the Board within 30 days with tenant names, phone, lease term, and confirm one tenant is 55+.
- What you own & maintain: You own your unit and share an undivided interest in common elements (land, facilities, pools, streets, utilities). You're responsible for interior utilities and your private patio: irrigation, weeds, trimming, debris, tree maintenance, and pest control. Citrus trees must be trimmed by the third week of March each year.
- Party walls & shared repairs: Dividing walls between units are jointly owned. Both owners share responsibility for structural repairs. If one owner causes damage, they pay; if damage is from other causes, both split costs equally. Disputes go to arbitration with a neutral third arbitrator.
- Architectural review & alterations: Any exterior changes—additions, fences, hedges, colors—require Board approval. TV/satellite antennas need approval (except over-the-air reception devices per FCC rules). Flagpoles and flags require Board consent unless legally required.
- Fences, walls & landscaping: Front-yard fences must stay behind building walls. Side/rear fences max 6 feet; hedges max 3 feet. Units bordering the golf course: no fence taller than 6 feet within 18 feet of the rear line, with portions over 3 feet limited to wrought iron. Landscaping must not obstruct golf course views.
- Pets & restrictions on use: No livestock or poultry allowed. Dogs and cats must stay confined to your lot. No house trailers or campers can remain for more than 48 hours. No business of any kind can operate from your unit or lot.
- Assessments & liens: The Board levies monthly assessments (payable in advance) to maintain common elements and carry master insurance. The Board has a lien on your unit for unpaid assessments and can foreclose like a mortgage (subordinate to bank mortgages). Special assessments require 60% owner approval.
