What Plaza De Los Medicos II's governing documents say
Plaza De Los Medicos II is a condominium regime of three commercial office buildings in Scottsdale, AZ — each unit owner owns one building and an undivided one‑third interest in the common elements. The association maintains common areas and carries master insurance, funded by per‑unit assessments. Use is restricted to medical offices, labs, pharmacies, and related health‑care services.
- Use & occupancy restrictions: Units may be used only for medical offices, medical laboratories, pharmacies, and related health‑care services, or other uses approved by the board. No spotlights or high‑intensity lighting without board approval. Signs are limited to a dignified name/address sign; no 'For Sale' or 'For Rent' signs on the property.
- Leasing & rentals: Leases must be for a term of at least 30 days, be in writing, and comply with the declaration, articles, and bylaws. A copy must be delivered to the association before the lease term begins.
- Parking & vehicles: Parking spaces are part of the common elements. The board has full authority to establish rules and manage parking for all owners.
- Architectural control & alterations: No exterior alterations, additions, or changes (including fences, walls, awnings, signs, landscaping) visible from the outside are allowed without board approval. Interior alterations within a unit do not require board approval but the owner is responsible for any damage to other units or common elements. Structural changes to buildings or exterior portions require a majority vote of owners.
- Assessments & fees: Each owner pays a proportionate share of common expenses (1/3 per unit). Assessments begin the first month after the first unit is sold to a non‑declarant owner. Late payments incur 12% annual interest and a late charge up to 25% of the amount due. Special assessments for capital improvements require a 2/3 vote of owners.
- Insurance: The association must maintain casualty insurance covering the buildings and common elements at 100% replacement cost, and liability insurance with at least $3,000,000 per occurrence. Owners may obtain their own insurance for personal property and improvements, as long as it does not impair the association's policies.
- Maintenance & repairs: Each owner maintains the interior of their building and exclusively serving systems (HVAC, plumbing, electrical). The association maintains all other portions, including exteriors, bearing walls, roofs, walkways, and common elements. Damage caused by an owner's negligence must be paid by that owner, and the amount is secured by a lien.
