What Privada's governing documents say
This is a Restrictive Covenant recorded by the developer of The Reserve at Pinnacle Peak Patios (a townhome community in Scottsdale, AZ) in favor of the neighboring Privada and Estancia community associations. It imposes detailed design guidelines on the property that run with the land, binding all future owners. If you buy a home here, these rules control what you can build, landscape, park, and decorate — they are not optional guidelines but enforceable restrictions.
- Building height & setbacks: Maximum building height is 28 feet from natural grade for most units; the 8 units closest to the northern property line are limited to 24 feet. No vertical construction (except retaining walls) is allowed within 50 feet of the northern property line, and none at all within 75 feet of the northwest corner.
- Parking & vehicles: Each residence must have a minimum 2-car enclosed garage plus 2 additional guest parking spaces on the lot (minimum 9x18 feet each). On-street parking is prohibited between midnight and 7 AM. No overnight exterior storage or parking of boats, RVs, motor homes, or similar vehicles is allowed.
- Exterior lighting: Lighting must minimize visibility from off-site and preserve the dark sky. Maximum fixture wattage is 300 lumens (equivalent to a 20W incandescent bulb). Uplighting allowed on a maximum of 3 trees per residence, with no more than 1 fixture per tree. All exterior lighting must be shielded and directed downward. Motion sensors on secondary lights are prohibited. Visual enjoyment lighting (e.g., patio lights) may only be used between dusk and midnight.
- Holiday decorations: Decorations must be tasteful and subtle. No 'lawn ornament' type or plastic sculptures. No chasing, twinkling, or blinking lights. No more than 5 trees/cacti/plants may be decorated with lights. Lights may not outline an entire home. Christmas decorations allowed only between Thanksgiving and January 7th. Decorations for other holidays: installed no more than 2 weeks prior, removed within 1 week after.
- Antennas & satellite dishes: Satellite dishes larger than 1 meter (39 inches) are prohibited. All dishes must be placed to minimize visibility from streets and neighbors, and must be painted to match the house. Installation requires prior approval from the homeowners association.
- Landscaping & native plants: Only plants from the Approved Plant Materials List (Appendix A) may be used in natural and revegetated areas. Non-indigenous plants are allowed only in private, walled areas. Protected native plants must not be damaged or removed; if impacted by construction, they must be relocated within the property. Revegetation must match the adjacent natural desert.
- Construction activity restrictions: Construction hours: summer (April 1–Oct 31) 6:00 AM–7:00 PM Mon–Fri, 7:00 AM–7:00 PM Sat, no Sunday; winter (Nov 1–Mar 31) 7:00 AM–5:00 PM Mon–Fri, 8:00 AM–5:00 PM Sat, no Sunday. All staging must be in the southern half of the property and screened. Dust and trash must be mitigated.
