What Canada Village's governing documents say
Canada Village is a standard single-family home subdivision in Buckeye, Arizona, governed by a homeowners association (Canada Village Association, Inc.). Every lot owner automatically becomes a member of the association and must comply with the recorded covenants, conditions, and restrictions (CC&Rs). These rules cover property use, construction standards, assessments, and common area rights.
- Single-family residential use: All lots are limited to single-family residential use only. No business, commercial, religious, or institutional uses are allowed. Each lot may have one dwelling house plus customary outbuildings, garage, carport, and swimming pool.
- Minimum house size: Any dwelling house must have a ground floor area of at least 725 square feet, exclusive of open roofed areas, pergolas, attached garage, or carport.
- Renting & leases: Only an entire lot with its improvements may be rented, and only to a single family. Leases must be for at least 31 days. Tenants must agree to comply with all CC&Rs. Transient or hotel use is prohibited.
- Pets: Only commonly accepted household pets are allowed, and they cannot be kept for commercial purposes. No horses, livestock, or other animals without board approval. The board may further limit the number, kind, or activity of pets. Pets are not allowed on common areas.
- Architectural review: No building, fence, wall, or other structure may be erected or altered without prior written approval of the board or its architectural committee. Plans showing nature, kind, shape, height, materials, color, and location must be submitted; approval is deemed given if not disapproved within 30 days. This does not apply to the declarant's original construction.
- Parking & vehicles: No trucks, buses, vans, or trailers may be parked in streets or front yards, except for service vehicles during daylight hours. Vehicles larger than a three-quarter ton pickup must be kept only on Tract 'B' (designated storage area) and may incur a separate parking charge. Recreational vehicles are also restricted to Tract 'B'.
- Assessments & fees: Each lot owner must pay annual assessments, special assessments for capital improvements, and individual assessments for maintenance failures. The annual assessment is 1/134th of the total budget. The initial maximum annual assessment was $40 per month per lot, subject to annual increases based on the Consumer Price Index or by a two-thirds vote. Delinquent assessments bear 12% interest and late charges, and create a lien on the lot.
- Common areas & use rights: The association owns Tracts A, B, and C as common areas. Tract A is for recreation and open space; Tract B is for sewerage disposal and vehicle storage; Tract C is for private streets. Owners have an easement to use common areas, but the association may charge fees, suspend rights for nonpayment or rule violations, and dedicate common areas with a two-thirds vote. Owners may delegate use to family or tenants.
