Marwest Estates is a single-family residential subdivision in Goodyear, AZ. This Declaration of Restrictions imposes use and building standards on all lots and runs with the land. Homeowners and buyers must comply with these covenants, which include minimum house size, setbacks, and architectural approval.
- Property use & building restrictions: Lots may only be used for residential purposes. Dwellings must have at least 1,200 square feet of living area (excluding porches, carports, garages) and be built with new, approved materials. No garage or outbuilding may be built before the dwelling, though guest/servant quarters in such buildings are allowed.
- Architectural review: Before any structure is built, its design, location, and materials must be approved in writing by a committee of four named persons (later replaced by a committee selected by lot owners after 75% of lots are sold). If the committee fails to act within 30 days of a written request, approval is not required as long as the structure is in harmony with existing buildings.
- Lot size & setbacks: No lot may be resubdivided into parcels smaller than one gross acre. A 40-foot setback from the front lot line and a 30-foot setback on side lines must be maintained.
- Animal restrictions: Noxious animals, specifically swine (pigs), may not be kept or maintained. All livestock must be kept in strict compliance with state, county, or local health and safety regulations.
- Duration & amendment: The restrictions and covenants run with the land until January 1, 1982, and then automatically extend for successive 10-year periods unless changed by a vote of a majority of lot owners. A violation does not affect the lien of any mortgage.
- Trailer use: No trailer may be used for dwelling purposes unless it has at least 600 square feet of living area plus 600 square feet of porches, pergolas, or carports, equating to the same restrictions as dwellings.
- Sanitary facilities: All dwellings must have flush toilets, and all bathrooms and sanitary conveniences must be inside permitted buildings. Until sewers are available, they must connect to septic tanks/cesspools meeting county and state standards.
