Scottsdale Old Town Plaza is a condominium project in Scottsdale, AZ, with four commercial units (office/medical use only — no residential). The governing document is a Declaration of Condominium and Covenants, Conditions and Restrictions that applies to unit owners.
- Use restrictions: All units are restricted exclusively to commercial (office/medical) purposes. Leasing is allowed only for commercial use. No noxious or offensive activities, no illegal uses, and no outdoor clotheslines or reflective materials on windows.
- No animals: No animals, birds, fowl, poultry, or livestock may be kept in any unit or on any other portion of the condominium.
- Parking & vehicles: Vehicles must be parked only in designated parking spaces. Parking spaces are limited common elements assigned to units. No vehicle repairs, storage of inoperable vehicles, or parking on streets within the project. The Board may prohibit vehicles that are noisy or unsightly.
- Assessments: Each unit owner must pay annual assessments for common expenses, payable in 12 monthly installments. Assessments are based on the unit's undivided interest in common elements. Late payments accrue 18% annual interest, and unpaid assessments become a lien on the condominium. Special assessments require 51% vote of owners.
- Insurance: The Association maintains master property, liability, flood, and fidelity insurance covering the project and common elements. Owners may obtain their own insurance for personal property and improvements.
- Alterations & maintenance: Owners may decorate and construct partition walls inside their units, but cannot impair structural soundness or encroach on common elements without Board consent. No alterations to common elements without Board approval. Owners must keep their unit interiors in good repair; the Association maintains the exterior and common elements.
- Signs: Only a dignified name/address sign is allowed on units. For-sale or for-rent signs require Board approval. A master sign may be placed by the Board.
