Scottsdale Medical Pavilion is a commercial condominium in Scottsdale, AZ — you own your unit and a share of the common elements, but the entire property is restricted to commercial or medical office use only. No residential use is allowed. The association maintains the building and common areas, funded by assessments based on unit square footage.
- Permitted use: Units must be used exclusively as commercial or medical office space; residential use is prohibited. The Declarant may lease units to commercial/medical users.
- Leasing & rentals: Units may be leased for a minimum term of one year. All leases must be in writing and subject to the governing documents.
- Pets: No animals, birds, reptiles, or insects are allowed except fish maintained in aquariums (not for commercial purposes). Service animals are permitted as provided by law.
- Parking & vehicles: No boats, campers, trailers, mobile homes, commercial vehicles (except standard pickup or van), or inoperable vehicles may be parked on common areas. Vehicle repair is prohibited. The association may tow improperly parked vehicles.
- Assessments & fees: Annual and special assessments are levied per unit proportionally to floor area. Annual budgets set amounts; special assessments require 75% member approval. Delinquent assessments accrue 20% interest and late charges; voting rights are suspended after 60 days.
- Voting rights: Each unit gets one vote plus one additional vote per each 1,000 square feet over 1,000 square feet. Voting is suspended for unpaid assessments. Proxy voting is allowed.
- Fines & enforcement: The board may levy fines of up to $50 per day for violations. Fines and collection costs become a lien on the unit.
