Sunland Springs Village Garden is a 55+ age-restricted condominium community in Scottsdale, AZ. You own your individual unit's interior and utilities serving only your unit; the association owns and maintains the building structure, exterior, grounds, and all systems serving multiple units. You pay assessments to both the condo association and the master Sunland Springs homeowners association.
- Age restriction (55+): At least one occupant per unit must be 55 years or older; generally, no one under 45 can occupy a unit. Exceptions: guests under 45 for up to 30 days per 6-month period; children under 21 with a parent/guardian if the Board grants a hardship exception; adult children 18–45 living with a parent/guardian. The Board may waive the 55+ requirement if it keeps at least 85% of units occupied by someone 55+.
- What you own & maintain: You own your unit's interior (including finished surfaces like flooring, walls, ceiling, doors, and windows) and any utilities serving only your unit. The association maintains the building structure, exterior, grounds, roof, and any systems or utilities serving multiple units, and carries master insurance on all common elements.
- Unit sizes & assessment allocation: Three floor plans: Type 1250 (1,520 sq ft, 14.37% share), Type 1500 (1,798 sq ft, 17.00% share), and Type 1700 (1,970 sq ft, 18.63% share). Your Common Expense Assessment is calculated as your unit's percentage of total living area, so assessments vary by unit type.
- Limited common elements (patios, etc.): Certain common areas are allocated exclusively to your unit: patios adjoining your unit, shutters, awnings, window boxes, doorsteps, stoops, porches, and exterior doors/windows. You have sole use of these features.
- Leasing & access to common elements: Your unit can be leased or rented. While leased, the tenant and their family have exclusive right to use common elements (including pools, clubhouse, etc.); you (the owner) cannot use them until the lease ends.
- Master association membership: The condominium is part of Sunland Springs Village master planned community. You pay assessments to both the condo association and the master association, and both sets of rules apply—if rules conflict, the more restrictive one governs.
- Future expansion: The developer retained the right to add up to 90 additional units to the condominium (expiring seven years after the 1999 recording date). If units are added, your percentage share of common elements and expenses will be recalculated based on total living area.
