The Auto Plaza is a commercial condominium in Scottsdale, AZ—you own your individual commercial unit and share ownership of the common elements (parking, landscaping, driveways, fences), which the association maintains and insures through owner assessments. The property is strictly for commercial, industrial, or office use with no residential occupancy allowed; two units have specific restrictions related to vehicle rental operations.
- What you own & maintain: You own your unit's interior and exterior (walls, windows, roofs, fixtures). The association maintains common areas including parking, driveways, landscaping, fences, sidewalks, and retention basins. Each owner has an allocated undivided interest in the common elements.
- Commercial use only: No residential use is permitted. Unit A cannot be used for automotive repair except incidentally to vehicle rental operations. Unit B cannot be used for any vehicle rental business or competing business. All other commercial and industrial/office uses are permitted.
- Architectural & design review: Any exterior alterations, additions, signs, fences, walls, or structural changes require written Board approval before work begins. The Board has 30 days to approve or disapprove (extendable 30 more days); if the Board doesn't respond within the timeframe after you comply with procedures, approval is not required. The Board may charge a reasonable fee to cover examination costs.
- Parking, vehicles & storage: All driveways and parking areas must be paved. You must provide sufficient parking and loading facilities on your site. The Board can prohibit any motor vehicle it determines creates loud noises or is unsightly. Outdoor storage must be screened from view by an opaque screen not higher than 8 feet.
- Exterior design & restrictions: No window air conditioners, spotlights, or high-intensity lighting without approval. Mechanical equipment and roof-mounted equipment (max 3 feet above parapet) must be screened and not visible from the street. Exterior colors and materials must be coordinated for design continuity on all elevations.
- Maintenance obligations: You must keep your unit's interior and exterior walls, windows, ceilings, floors, roofs, and fixtures in clean, sanitary condition and good repair. If you fail to correct unsanitary or unsafe conditions within a reasonable time after written notice, the Board may enter and make repairs at your expense.
- Assessments & common expenses: Each owner pays annual assessments based on estimated expenses for maintaining and operating common elements, including management, insurance, repairs, maintenance, landscaping, utilities, legal/accounting fees, and reserves.
- Prohibited uses & activities: No junk yards, salvage operations, or activities creating noxious odors, fumes, dust, smoke, noise, pollution, or hazards. No temporary structures, tents, shacks, barns, or trailers. No extraction of water, oil, minerals, or earth materials. Garbage must not be visible.
