Sunrise Corporate Center is a commercial condominium in Scottsdale, Arizona — you own an individual office or warehouse unit and share ownership of the building's common elements (parking, landscaping, exterior, roof, utilities), maintained by the Association and funded by per-unit assessments. This is strictly a business property; no residential use is allowed.
- Commercial use only: All units are for office and warehouse purposes only. Residential use is strictly prohibited. The Association can prohibit any motor vehicles, equipment, or activities that create noise, odor, fumes, dust, smoke, pollution, or other nuisances.
- What you own & maintain: You own your unit's interior (walls, windows, ceilings, floors, fixtures, heating/AC system). The Association maintains the exterior (walls, roof, common areas, parking, landscaping, driveways, sidewalks, refuse collection), funded by assessments. Limited common elements (assigned parking spaces, entryways) are your exclusive use but shared maintenance.
- Architectural & exterior controls: Any exterior changes, repairs, color changes, additions, fences, signs, antennas, or equipment require Board approval (unanimous consent required). The Board must respond within 30 days or approval is automatic. Specific requirements: concrete/masonry construction only, underground utilities, screened roof/mechanical equipment, paved driveways/parking. The Board may charge reasonable fees for plan review.
- Assessments for common expenses: Owners pay annual assessments based on the Association's estimated costs for management, insurance, repairs, maintenance, employee wages, utilities, legal/accounting, and reserve funds. Assessments are apportioned by your undivided interest percentage in common elements, as set out in the recorded Plat (Exhibit C). The Board can levy additional assessments if funds prove inadequate.
- Parking spaces: Each unit has assigned parking space(s) (designated as limited common elements). All parking areas must be paved and maintained to Town of Gilbert standards. Expenses for parking maintenance are equally assessed among units assigned to those spaces.
- Board & governance: The Declarant controls the Board until 4 years after ceasing to offer new units or 90 days after 75% of units are sold, then ownership transfers to the Owners. The Board has four members representing the units. Owners are automatically members of the Association upon purchase; membership terminates upon sale.
- Title & transfers: Your ownership of the unit and your undivided interest in common elements are inseparable — both transfer together, and neither can be mortgaged separately from the other. The Declaration runs with the land and binds all future owners. Foreclosure does not relieve owners from Declaration obligations.
