What Country Trace Two's governing documents say
Country Trace Two is a planned community of attached single-family homes (with party walls) in Phoenix, AZ, governed by a homeowners association (the Association). Each homeowner owns their lot and dwelling and shares responsibility for common areas. The covenants, conditions, and restrictions (CC&Rs) create a uniform set of rules for all owners, including assessment obligations, use restrictions, and architectural control.
- What you own & maintain: You own your lot (a parcel designated on the plat) and the dwelling constructed on it. The Association maintains the common areas (Tracts A and B as shown on the recorded plat) and may require owners to maintain their lots. Party walls (walls on the dividing line between lots) are jointly maintained by adjoining owners.
- Assessments & fees: Each lot is subject to annual assessments (initially up to $144 per year, adjusted by CPI or by member vote), plus supplemental and special assessments. Assessments are a personal obligation of the owner and a lien on the lot. Delinquent payments accrue interest at 12% per annum and may result in foreclosure. No offsets against assessments are allowed.
- Leasing & rentals: An owner may lease only the entire lot, not a portion. The minimum lease term is 30 days. Leases must be in writing and subject to the CC&Rs; the owner must notify the Association of the lease terms and lessee's name.
- Pets: No more than two dogs or cats per lot, kept as domestic pets only (not for commercial purposes). Animals must not be a nuisance, and enclosures must not be visible from neighboring property.
- Architectural review: An Architectural Committee (appointed by the Board) must approve all exterior alterations, improvements, fences, landscaping, window coverings, HVAC, solar panels, and other changes that alter exterior appearance. Decisions of the Committee are final.
- Parking & vehicles: No mobile homes, motor homes, trailers, trucks, campers, boats, or similar vehicles may be parked on lots or streets except in designated areas. Inoperable vehicles and major repairs visible from neighboring property are prohibited. Garage doors must be kept closed except for ingress/egress.
- Use restrictions: All lots are for single-family residential use only. No businesses, trades, or nonresidential uses. No signs except one small residential ID sign and one temporary "for sale" sign during open houses. No outdoor burning except barbecues. No antennas visible outdoors. No time-sharing or subdivision of lots.
- Party walls: Walls on lot dividing lines are party walls. Adjoining owners share repair and maintenance costs proportionally. Damage from fire or ordinary wear is rebuilt at joint expense. Modifications require written consent of the adjoining owner and the Board. Disputes go to arbitration.
