This document is a partial Tract Declaration for Superblock 11, Parcel 2, filed by the developer. It does not contain the full rules for homeowners (like age, leasing, or pets); instead, it designates common areas, grants utility and visibility easements, and assigns wall maintenance responsibilities. - Common Areas & Easements: Common areas (Tracts A–G) are designated on the final plat. The developer grants public utilities easements (8 ft typical), vehicular non-access easements (1 ft), sight visibility triangles (e.g., 33x33 ft on certain lots), key lots for visibility, sidewalk easements (10 ft and 20 ft), and drainage easements over certain tracts. Perimeter fences/columns adjacent to such streets are the Association's responsibility. If an owner or their guests willfully or negligently damage any such wall/fence, the owner pays for repairs.
- Exclusive Use Easements (Easement Areas): On common areas where perimeter walls are set back from lot lines, a strip of common area (Easement Area) is granted for exclusive use by the adjacent owner (Dominant Lot). The owner may landscape but not build structures in that area. The Association retains access for wall maintenance. The owner indemnifies the Association for any claims related to the Easement Area.
