What The Center at Mcdowell Mountain's governing documents say
The Center at McDowell Mountain is a commercial condominium community in Scottsdale, AZ — you own a unit in a development restricted to I-1 industrial uses. The association maintains common elements and enforces architectural and use rules. All units must be used for non-residential purposes permitted by I-1 zoning.
- Use restrictions: No residential use is permitted. All units must be used only as allowed by the City of Scottsdale I-1 zoning, and no noxious or offensive activity is allowed.
- Architectural review: Any exterior alterations, additions, or changes require prior written approval by unanimous consent of the Board of Directors. Plans must include elevations, site plan, and other details. The Board may charge a fee for review and must act within 30 days.
- Assessments & liens: Annual assessments fund common expenses; special assessments require a 60% vote of total association votes. Late payments incur a 5% late fee and 18% annual interest. Unpaid assessments become a lien on the unit enforceable like a mortgage.
- Insurance: The association must maintain property insurance on common elements (full replacement cost), liability insurance of at least $1 million per occurrence and $2 million umbrella, and directors & officers insurance. Unit owners must insure their own unit and personal property.
- Parking & vehicles: Parking spaces are limited common elements assigned to units. No on-street parking is intended; all parking must be on-site. Loud or unsightly vehicles may be prohibited. Truckwells may be used by one owner for no more than 90 minutes.
- Maintenance responsibilities: Unit owners maintain the interior of their unit, including HVAC and windows. The association maintains exterior walls, common elements, and limited common elements such as entryways, canopies, and assigned parking spaces.
