What The Peaks's governing documents say
The Peaks is a commercial office condominium complex in Scottsdale, AZ, governed by a Master Declaration. It is not a residential community. The property is divided into parcels that may be further subdivided into condominium units. The rules apply to parcel owners, unit owners, and their tenants and visitors. An Administrative Agent (initially the developer, later the owners' association) oversees common areas, assessments, and enforcement.
- Permitted and prohibited uses: The property is restricted to office/commercial uses. Residential purposes, hotels, churches, hospitals, schools, and many other uses are expressly prohibited (see Section 3.3 for full list).
- Outdoor use and signage: Outdoor activities must be within enclosed buildings except for limited parking, deliveries, and approved seating. All signs, including building-mounted signs, require Administrative Agent approval. 'For Sale' or 'For Rent' signs are prohibited without approval.
- Architectural review: Any construction, reconstruction, or exterior alteration requires prior approval from the Architectural Committee. Plans must be submitted, and if not disapproved within 30 days, they are deemed approved.
- Assessment obligations: Each parcel owner must pay assessments levied quarterly, based on the gross floor area of buildings on the parcel. Assessments fund common area maintenance, insurance, and other administrative costs. Unpaid assessments accrue interest and can become a lien.
- Maintenance responsibilities: Parcel owners maintain their own buildings, parking areas, and outdoor seating. The Administrative Agent maintains common areas (access drives, landscaping, storm drainage, monument sign).
- Parking rules: Each parcel must have sufficient on-site parking. A non-exclusive easement allows shared parking across parcels, but no more than 20% of spaces on a parcel may be reserved.
- Enforcement and penalties: The Administrative Agent may enforce the declaration through abatement, lawsuits, and liens. Violators must pay all enforcement costs, including attorney fees. Interest accrues at prime rate plus 8%.
