Residence Club Scottsdale at Troon North is a timeshare/interval ownership community. You purchase an undivided fee interest in the property, which entitles you to use a specific unit for a designated week (or alternate-year week) annually. The document establishes the owners' association, use rights, fees, and restrictions.
- Ownership & use rights: You own a fractional interest (Annual or Alternate Year) and a right to occupy a unit during a reserved Use Period (up to 7 nights). Use rights are for private residential purposes only; commercial use is prohibited.
- Reservation system & use periods: Reservation windows: 13 months in advance for owners of multiple intervals reserving concurrent weeks, 12 months for others. Owners may reserve floating weeks within Platinum, Gold, or Silver seasons; fixed weeks are preset. Split-week and lock-off use may be allowed per Board rules.
- Rental & occupancy: Owners may allow guests or lessees to occupy their unit during their Use Period, but rental pool arrangements are forbidden. The Declarant has exclusive rights to rent unreserved units to the public until a certain vote by owners changes that.
- Assessments & fees: Annual Basic Assessments are levied per interval, with Alternate Year intervals paying half. Special, Tax, and Reconstruction Assessments may also apply. Assessments fund maintenance, operations, reserves, and management.
- Seasons & week types: Three seasons: Platinum (weeks 1-21, 50-52), Gold (22-27, 36-49), Silver (28-35). Fixed weeks are limited to 20% of intervals during Platinum; owners may convert fixed to floating.
- Alterations & maintenance: No alterations, additions, or redecorating of units or common furnishings without Association consent. The Association holds easements to enter units for maintenance, repairs, and emergencies.
- Declarant's rights: Declarant retains extensive rights: to build future phases, rent unreserved units, use units as sales offices, and assign easements. These rights may terminate after 10-15 years or upon a vote of owners.
- Transfer & resale: Resale of intervals is governed by the declaration; a Statement of Status must be provided showing delinquencies. Declarant may also convey intervals to the Association.
