This is an ancillary, neighbor-to-neighbor restrictive covenant that burdens a single vacant lot (Lot 232) in The Saguaro Forest at Desert Mountain, a Scottsdale subdivision. It permanently restricts construction on that lot to preserve it as natural desert, and it gives enforcement rights to the owner of the adjacent Lot 231 and to the homeowners association (on behalf of other nearby lots). This is not a full set of community rules—it applies only to one lot and addresses only construction limits.
- Construction & use restriction: Lot 232 must be permanently retained primarily as natural desert. No dwelling units, buildings, common-area amenities over 60 inches tall, or vertical structures related to them may be built on it.
- Allowed limited improvements: DMP (the original owner) reserved the right to permit minor signage or private utilities no more than 60 inches above grade, and to construct other improvements on Lot 232 only with the prior written consent of both the adjacent Lot 231 owner and the Association.
- Who can enforce the restriction: The owner of Lot 231 (the Primary Benefited Property) and the homeowners association (acting for the owners of Lot 230 and Lots 233–237) each have the right to enter Lot 232 and go to court to stop any activity that violates the covenant.
- Amendment & termination: This covenant can only be amended or modified by a recorded document signed by the then-current owners of both Lot 232 and Lot 231 and by the Association. It runs with the land indefinitely unless amended.
- What this document doesn't cover: This is a single ancillary covenant that applies to one lot (Lot 232) only. It does not describe any association rules about pets, leasing, parking, fees, membership rights, or amenities for the community at large.
