Thunderbird East is a standard single-family-home subdivision in Scottsdale, AZ. These restrictive covenants apply to individual lot owners and are designed to maintain the residential character of the neighborhood. The covenants cover construction standards, setbacks, fences, lot use, and aesthetics, with automatic renewal every 10 years after 1996 unless a majority of owners vote to change them.
- Land use & residential purpose: All lots are for residential use only. No churches, offices, schools, places of business (except model homes), hospitals, or other non-residential uses are allowed. No outbuilding may be built for lease, sale, or rent.
- Construction standards & approvals: All construction must be new, performed by a registered contractor under a building permit, and continuously pursued. The main residence must be at least 2,000 square feet under roof and no more than one story (split-level or basement homes are allowed). Subsequent construction must be architecturally compatible with the primary residence and comply with 25-foot side and rear setbacks.
- Fences & setbacks: Front fences over 3 feet high must be set back at least 10 feet from the front street line. Side and rear fences may not exceed 6 feet (except building walls). All fences must be built with new materials, under a permit, and maintained in good condition.
- Pets & animals: No horses, cattle, sheep, goats, mules, burros, swine, or poultry are allowed. (Domestic pets like dogs and cats are not restricted by these covenants.)
- Aesthetics & maintenance: Garbage cans must be kept out of view from roadways and neighbors. No burning of trash. No highly reflective roof coatings, aluminum foil on windows, or dismantled vehicles. Advertising signs limited to 8 square feet and only "For Sale" or "For Rent." Natural growth must not become a detriment to adjoining lots. Undeground tanks must be buried.
- Lot division & consolidation: Lots cannot be resubdivided into smaller parcels, but adjoining lots may be combined into a single parcel with equal or greater street frontage or area. Combined lots are treated as one lot for covenant purposes.
- Duration & amendment: These covenants run with the land and are binding until January 1, 1996, after which they automatically renew for successive 10-year periods unless a majority of lot owners vote to change them.
