The document imposes a 10-year charter school use restriction, then allows other uses including single-family residential if annexed into the larger community, and includes architectural control by the original developer.
- Use restrictions: For the first 10 years from recording (2016), the property may only be used for a public charter school and accessory uses, unless the Declarant approves otherwise. After that period, the property may be used for single-family residential (including condominiums) only if annexed into the Marley Park Community Charter, or for any other use permitted by the City of Surprise zoning code.
- Maintenance & boundary walls: The Owner must maintain the property and improvements per prevailing standards. Specific rules govern boundary walls shared with adjacent residential lots: the Owner is responsible for repair if the wall is damaged by the Owner or its Permittees, and the cost is split with the adjacent lot owner if damage is from other causes. The Owner must also maintain any non-boundary walls (temporary fences).
- Architectural control: All site work, landscaping, structures, and other improvements require prior written approval from the Declarant (or its designee). The Declarant has sole discretion and may base decisions on aesthetic considerations. Approval is deemed given if the Declarant fails to respond within 30 business days. Interior work generally does not require approval unless visible from outside.
- Duration & termination: The Declaration runs for 30 years from recording. Use restrictions (Sections 2.1, 2.2, 3.1) and architectural control (Article 4) automatically expire after 30 years unless extended. Boundary wall and general provisions continue until terminated by written instrument signed by Declarant, Owner, and all lot owners.
- Amendments & enforcement: The Declaration may only be amended by a written instrument signed by Declarant and the Owner(s) of the entire property (and all lot owners for boundary wall amendments). Declarant has the right to enforce use restrictions and architectural control, and may assign enforcement rights. Prevailing parties in enforcement actions may recover attorney's fees and costs.
