Mulwood Spring is a planned residential development (PRD) in Paradise Valley, AZ, governed by a homeowners association (HOA). You own a single-family home lot and share common areas like the pool, clubhouse, and private drive. The association maintains common areas, carries master insurance, and levies assessments on all lots. This document binds all lot owners, their tenants, and guests to the community's rules.
- What you own & maintain: You own your lot and the single-family residence on it. The association owns and maintains all common areas (Tracts A, B, C) including the private drive, pool, clubhouse, and landscaping. Each owner must maintain their own unit and lot, and the association insures the structural portions of the units and common areas.
- Leasing & rentals: Rentals are allowed but must be for single-family residential use with a minimum lease term of 30 days (no short-term or vacation rentals). All leases must be in writing and subject to the governing documents; the owner is responsible for tenant compliance.
- Pets & animals: You may keep a reasonable number of customary household pets (dogs, cats, etc.) on your lot, but only as domestic pets, not for commercial purposes. No poultry, fowl, or exotic animals are allowed.
- Architectural review: An Architectural Committee (appointed by the Board) must approve all exterior changes, including structures, antennas, signs, and landscaping alterations. No temporary structures (except during construction) or above-ground utility lines are permitted without approval.
- Assessments & fees: Annual assessments are levied uniformly on all lots, initially capped at $780 per lot (1984), adjustable annually by CPI or by a 67% member vote. The association may also levy special assessments for capital improvements. A working capital deposit of two months' assessments is required from new purchasers.
- Use restrictions: Lots are for single-family residential use only. No business, commercial, or offensive activities are allowed. No further subdivision of lots, no condominium conversion. All owners must subscribe to trash service and keep lots free of debris.
