This is the Declaration of Covenants, Conditions and Restrictions (CC&Rs) for La Paz at Desert Springs, a single-family residential subdivision in Scottsdale, AZ. It applies to all lot owners and sets rules for building, property use, and architectural control. No formal homeowners association is created; enforcement relies on the Architectural Control Committee and individual owners.
- Architectural review: All structures, fences, landscaping, and exterior changes visible from streets or common areas require prior written approval from the Architectural Control Committee. Plans must be submitted showing design, materials, colors, and location; approval or denial must occur within 30 days of submission.
- Building & lot use: Lots are limited to one single-family residence (max 2 stories, except Lots 1,6,7,12,13: one story only). Minimum ground floor area: 1,600 sq ft for one-story, 800 sq ft for two-story. Maximum lot coverage: 40%. Minimum lot size: 9,400 sq ft, width 54 ft, depth 119 ft. No temporary structures, trailers, tents, or commercial use.
- Fences & walls: Front yard fences or walls over 3 ft high are prohibited; side/rear fences up to 6 ft allowed. Corner lot fences must not obstruct visibility. Common fences between lots share maintenance costs equally.
- Pets: Household pets (dogs, cats, etc.) are allowed but not for commercial breeding or keeping. No livestock or poultry.
- Vehicles & parking: Inoperable or abandoned vehicles must be hidden from view. No vehicles over 1 ton, mobile homes, trailers, boats, or campers may be parked on streets, driveways, or front/side yards; they may be parked in rear yards if not visible from streets or common areas.
- Signs & antennas: Only one sign up to 5 sq ft per lot advertising sale or rent, no commercial signs. No visible TV antennas. Roof-mounted air conditioning units are prohibited; all mechanical units must be ground-level.
- Enforcement & duration: Violations can be enforced by any lot owner through legal action, with attorney fees awarded to the prevailing party. The CC&Rs run for 35 years from recording (1989) and automatically renew for successive 10-year periods unless amended by a majority of lot owners.
