Hamelot is a single-family home homeowners association (HOA) community in Phoenix, AZ. These CC&Rs apply to all lot owners and residents, establishing rules for property use, assessments, maintenance, and architectural control.
- Residential use & occupancy: Lots must be used for single-family residential purposes only. A 'single family' is defined as persons related by blood/marriage/adoption, or a group of up to three unrelated persons living as a common household. Home-based businesses are allowed if not detectable from outside and conforming to zoning.
- Architectural review: Any exterior alteration, construction, or change (including color, fencing, landscaping, and structures) requires prior written approval from the Architectural Committee. The committee may charge a review fee and require a construction deposit. If no decision is made within 30 days, approval is deemed given. Variances may be granted in extenuating circumstances.
- Pets: No animals, birds, fowl, or livestock may be kept except domestic pets: up to two dogs, two cats, two parakeets, or similar household birds. Dogs and cats must be confined to the owner's lot unless on a leash no longer than six feet. No animal may create a nuisance or unreasonable noise.
- Parking & vehicles: No trucks, trailers, campers, boats, or recreational vehicles may be parked visible from neighboring property without approval. Inoperable vehicles and repair work (except emergencies) are prohibited. Motorcycles, ATVs, and off-road vehicles may only be parked in garages. Street parking is limited to guest vehicles for up to 24 hours. Violators may be towed at owner expense.
- Leasing & rentals: Leasing of a residential unit is not considered a business. Lessees have the right to use common areas during the lease term; the owner loses those rights while the unit is rented. No minimum lease term is specified in this document.
- Assessments & fees: Annual assessments are levied per lot based on the association's budget. Special assessments require a two-thirds vote of members. Assessments are due quarterly (or as set by the board); late payments incur interest and fees, and a lien may be placed on the lot. A transfer fee is paid by the purchaser of a lot (amount set by board). A working capital fund of 1/6th of the annual assessment is also due from initial purchasers.
- Common area & maintenance: The association manages, maintains, and repairs common areas. Each owner must maintain their own lot and structures, including landscaping, in good condition. Owners are responsible for drainage easements on their lot. If an owner fails to maintain, the board may step in and charge the cost as an assessment.
