Sunburst Farms East Seven is a single-family home subdivision in Phoenix, AZ, governed by a homeowners association (Sunburst Farms East Mutual Water and Agricultural Company) that provides irrigation water and agricultural tillage services. The covenants bind all lot owners and are designed to preserve the rural-residential character, allowing limited livestock and requiring minimum dwelling sizes.
- Building & Use: Lots are restricted to single-family residential use. Only one single-family residence, a garage or carport, and a stable/livestock shelter/tack room are allowed. Dwellings must have at least 1,100 square feet of ground floor area (excluding open porches, pergolas, or attached garage). No used or inferior materials are permitted.
- Setbacks & Fences: Front walls must be at least 30 feet from the front property line; side walls at least 10 feet. Front porches, garages, or carports may project up to 5 feet into the front yard. Stables must be at least 25 feet from the main structure and 20 feet from side property lines. Solid walls/fences over 3 feet in height cannot be placed closer to the front street than the front wall of the residence; side/rear walls/fences can be up to 6 feet high. Hedges over 3 feet tall are prohibited within 20 feet of the front property line.
- Livestock & Pets: Horses, poultry, and livestock may be kept on lots for personal use, subject to state and local laws. Facilities must be maintained cleanly and not become a nuisance. Commercial animal husbandry is prohibited. Livestock facilities must be at least 8 feet from the front property line.
- Vehicles: No abandoned or inoperable vehicles may be stored or kept on any lot if visible from another lot or from any street or alleyway within the subdivision.
- Association Membership & Assessments: Each lot owner automatically becomes a member of the Sunburst Farms East Mutual Water and Agricultural Company. The association provides irrigation water and agricultural tillage services. Members must pay charges fixed by the Board; unpaid charges become a lien on the lot, bearing 5% interest per annum, and may be enforced by the association including power of sale. The member waives the right to exempt himself from charges by non-use.
- Enforcement & Duration: The covenants run with the land until January 1, 2003, and automatically extend for successive 10-year periods unless amended by majority vote of owners. The association or any owner may enforce violations and recover attorneys' fees. Invalidation of one provision does not affect others. While developer owns a majority, amendments require FHA and VA approval.
