Post Estates is a single-family home subdivision in Phoenix, AZ, governed by a Declaration of Restrictions recorded in 1980. These rules run with the land and bind all lot owners. The document establishes a Plan Review Committee for architectural approval and sets land-use restrictions.
- Permitted use: Lots are for single-family residential use only. No commercial enterprises, multifamily dwellings, or temporary structures (e.g., trailers, guest ranches) are allowed. A contractor may use a home as a temporary office or model home until all lots are sold.
- Lot restrictions: Lots cannot be re-subdivided. They may be combined under common ownership, and combined parcels are treated as one lot. No structures may be built on dedicated streets, easements, or utility areas.
- Architectural review: Before any structure is erected, its design, location, floor elevations, materials, and wall/fence heights must be approved in writing by Al Gazley or Kenneth Berg (until all lots sold) or by an elected committee of owner-residents. If no committee exists or no decision is made within 30 days of written request, approval is not required, but the structure must harmonize with existing homes.
- Parking & vehicles: Only private passenger automobiles may be parked on lots. No trucks, boats, recreational vehicles, or non-operating vehicles are allowed on streets or lots unless inside an enclosed garage. No travel trailers, campers, or other RVs may be parked even temporarily.
- Animals & livestock: No livestock, horses, cattle, pigs, goats, sheep, chickens, pigeons, fowls, rabbits, or poultry may be kept on any lot.
- Building standards: All structures must be new construction (no moving buildings onto lots). No structure may exceed one story without prior written approval. A dwelling house must be built or contracted before any garage or other building can be erected.
- Duration & amendment: These restrictions run with the land until January 1, 2000, and automatically renew for successive 10-year periods unless repealed or amended by a written agreement of the owners of 75% of the lots, recorded in the county records.
