What Sunnyside Linn's governing documents say
This document is the Declaration of Covenants, Conditions and Restrictions (CC&Rs) for Sunrise Unit Five, a single-family home subdivision in Paradise Valley, AZ. It applies to all lot owners and outlines rules for construction, property use, and maintenance. The community is governed by a homeowners association (HOA) and/or the original developer (Company).
- Minimum home size & construction standards: Single-story homes must have at least 1,900 sq. ft. of livable area (excluding garage, carport, etc.). Two-story or split-level homes require a minimum of 1,500 sq. ft. on the ground floor and 2,500 sq. ft. total. All homes must have an attached double garage (minimum 22' x 22' exterior) and a concrete or asphalt driveway.
- Architectural review & exterior approval: All construction, placement, colors, and exterior materials must be approved by the Company or Association. Metal roofs are generally prohibited where visible from grade, except for animal shades. No geodesic or A-frame homes, and no metal buildings except approved horse barns. Window coverings must be normal drapes, curtains, shutters, or blinds; materials like foil or newspaper are banned.
- Leasing & rentals: Leases for less than six months are not allowed, prohibiting short-term rentals. All leases must comply with the restrictions.
- Pets & animals: No more than two domestic pets per lot are permitted. Animal shades and corrals are allowed but must conform to Uniform Building Code and be approved.
- Lot maintenance & weed control: Owners of occupied lots must keep the lot clean of weeds and trash up to the pavement. For unoccupied lots, a 15-foot strip along the road must be weed-free; the rest may retain natural desert growth unless it becomes a fire hazard. The Association may clean and lien the lot after 30–40 days' notice if the owner fails to act.
- Duration & amendment: These restrictions run with the land until January 1, 1999, and automatically extend for successive 10‑year periods. A majority of lot owners can modify them by signing and recording an instrument during the 60‑day period before any renewal date.
- Enforcement & attorney fees: Violations may be restrained by court action, and the violator is responsible for all attorney fees and costs incurred by the Company or Association in enforcement.
