Tierra de los Reyes is a single-family home community in Scottsdale, AZ, governed by a homeowners association (Los Reyes Homeowners Association). This 1981 Supplemental Declaration establishes the association, sets assessments, and defines maintenance responsibilities and occupancy limits. Owners are bound by these rules, which supplement an earlier original declaration.
- Occupancy & use: Residences may only be used as a Single Family residence. 'Single Family' means a group of persons related by blood, marriage, or adoption, or up to 3 unrelated persons living together as a household.
- Maintenance responsibilities: The association maintains landscaping in front yards of lots and other common areas not maintained by the McCormick Ranch Homeowners Association (a master association) or the city. Owners are responsible for damage they or their guests cause to common areas.
- Assessments: Annual assessments are levied per lot. The initial maximum was $480 per improved lot and 5% of that for developed lots. Annual increases up to 10% are allowed without a vote; increases above 10% require a 2/3 vote of each membership class. Special assessments for capital improvements also require a 2/3 vote. Assessments are uniform per class (developed vs. improved) and create a lien if unpaid.
- Enforcement & liens: The association may sue for unpaid assessments and may record a lien against the lot. Interest accrues at 10% per annum. Foreclosure is possible. The assessment lien is subordinate to first mortgages.
- Amendment: The declaration runs with the land for 20 years from recording and auto-renews for 10-year periods. It may be amended by an instrument signed by at least 51% of lot owners.
- Membership & voting: Every lot owner is a member of the association. Owners get one vote per lot. The declarant initially held Class B membership with 4 votes per lot, converting to Class A when Class A votes equal Class B. Voting may be suspended for assessment arrears.
