Villa Montavo is a single-family residential planned community in Scottsdale, Arizona, where you own your individual lot and home. The homeowners association maintains all shared common areas (streets, landscaping, utilities, drainage) and is funded by assessments from lot owners, who are automatically association members. The Declaration establishes strict architectural controls and enforcement rules that bind all owners.
- What you own & maintain: You own your lot and dwelling unit; you cannot separate your home from your membership in the association or your right to use common areas. The association owns and maintains all common areas (streets, landscaping, walkways, drainage, utilities) and carries master insurance on those shared improvements.
- Assessments (annual & special): Initial annual assessment is capped at $720 per lot (reduced to half-rate for your first six months of ownership). After the first January 1 following the first sale, annual assessments can increase without a vote by the greater of the Consumer Price Index or 10%; larger increases require a two-thirds member vote. Supplemental and special assessments can also be levied for capital improvements or budget shortfalls, subject to approval requirements.
- Architectural review & restrictions: An Architectural Committee must approve plans before you make any exterior modifications. Extensive restrictions apply to building size and height, roofing, walls and fences, landscaping, air conditioners, solar panels, antennae, lighting, vehicle storage, garages, signage, and any improvement visible from a neighbor's property.
- Voting rights & membership: Every owner is automatically a member with one vote per lot. Voting rights are automatically suspended if you are 15 or more days behind on assessments, or if you default on a non-monetary obligation and do not cure it within 15 days of notice.
- Common area maintenance & insurance: The association is required to maintain, operate, and repair all common areas, obtain utilities and services (water, electricity, trash), and carry all necessary insurance covering the common areas and shared property.
- Unpaid assessments: liens & enforcement: Assessments unpaid after 30 days become a lien on your lot and accrue interest at 15% per year, plus late charges and collection costs. The association can foreclose the lien and is not required to release it until all delinquent amounts, interest, and fees are paid in full. The lien has priority over all other liens except first mortgages and property tax liens.
