- Insurance: association vs. owner responsibilities: The association maintains insurance on all Common Area improvements at 100% of current replacement cost (fire, extended coverage, vandalism). Each owner must individually obtain and pay for their own insurance on their Residential Unit, any other structures on their lot, and personal property — fire, liability, theft, and any other coverage they choose.
- Annual assessment due dates & delinquency: Annual assessments are due on or before January 1 each year and become delinquent if not paid within 30 days. If any assessment is late, the Board can accelerate all remaining assessments on that property. Assessments are considered paid only when the Association receives them; if a check dishonors, the obligation remains due and interest accrues from the original due date.
- Capital Preservation Assessment (new buyers only, 2025+): Owners who purchase after this amendment is recorded (December 2025) must pay a one-time Capital Preservation Assessment at escrow closing — an initial cap of $1,500 per unit, increasing no more than 10% annually without 67% member vote. The fee funds the Reserve Fund for common area capital improvements. If unpaid, it becomes a lien on the property. Existing owners are not subject to this fee.
