Grand Village Center is a commercial shopping center development in Sun City West, AZ, governed by a Declaration of Covenants, Conditions and Restrictions. This document binds all owners (pad owners) and occupants (tenants) to rules about permitted uses, exclusive rights, architectural design, and shared common area maintenance. It does not apply to residential homeowners — it governs a retail, office, and service-oriented commercial property.
- Permitted uses: The shopping center is limited to commercial purposes: medical office, professional, retail, service, restaurant, hotel, and ancillary facilities. Pad owners may also install canopies, signs, loading docks, and similar improvements.
- Exclusive use rights: Certain tenants have exclusive rights to operate specific businesses within designated buildings — for example, a water store, discount hair salon, greeting card store, vitamin store, floral shop, real estate office, nail salon, and a drugstore/pharmacy. These exclusives restrict other tenants in the same building or parcel from offering competing goods/services.
- Prohibited uses: No pad may be used for: pawn shops, second-hand stores, auction houses, thrift stores, flea markets, training/educational facilities, entertainment/recreational facilities (theaters, bowling alleys, arcades, nightclubs), or any use involving hazardous materials beyond what's customary in a first-class neighborhood shopping center.
- Architectural design review: All improvements (buildings, landscaping, signs) require approval from an Architectural Design Review Committee. Plans must include site plans, elevations, materials, landscaping, signage, and utility plans. The committee has 20 days to approve or object, and decisions are final if made in good faith.
- Common areas & expenses: Common areas (parking, sidewalks, landscaping, lighting, etc.) are maintained by the association or Declarant. All obligated owners pay a proportionate share of common expenses, which may be subject to liens if unpaid. Exempt owners (certain pads) may be excluded from paying common expenses.
- Building & height limitations: Buildings must be within designated building envelopes. Maximum height is generally one story or 25 feet for pads, with exceptions for major users (up to two stories or 28 feet). Canopies and overhangs may project up to 25 feet but must comply with laws and not reduce parking or access.
- What this document doesn't cover: This document does not address residential use, tenant rights beyond those stated, specific rent or lease terms, or rules for individual leases. It only covers the overarching covenants binding owners and occupants of the shopping center.
