Belcamp Condominium Association is a 55+ active-adult condominium community in Sun City, AZ. You own your unit and an undivided interest in common elements (land, pools, etc.). The declaration sets rules for all owners, residents, and guests, and is enforced by an elected Board of Management. This document is an amendment that replaces the original declaration.
- Age restriction (55+): At least one permanent resident per unit must be 55 years or older. No permanent resident under age 18 is allowed. A permanent resident is anyone who lives there more than 45 days in a calendar year.
- Leasing & rentals: New rentals are generally banned; no owner may rent or lease a unit unless the board grants a hardship exception (death, extended illness, job transfer). Existing rentals as of the amendment's adoption may continue until the owner sells or dies. Owners of rented units must provide the board documentation of the tenancy and confirm tenants are 55+.
- Pets: Dogs, cats, and other domesticated pets must be confined to the owner's unit except when on a leash. No other animals may be kept without prior written permission from the Board of Management.
- Architectural review: Structural alterations or additions to unit exteriors and changes to landscaping in common areas require prior written approval from the Board. Applications must include plans and specs; the board decides within 30 days based on conformity, safety, maintenance costs, codes, and neighbor impact.
- Assessments & liens: The Board levies monthly assessments payable in advance. Delinquent assessments, plus costs and attorney's fees, become a lien on the unit. The lien is subordinate to any bona fide institutional mortgage.
- Party walls: Walls between units are party walls owned in common. Structural repairs are the responsibility of the users; damage caused by one owner must be repaired at that owner's expense. Damage from other causes is shared equally. Disputes go to arbitration.
- Voting & meetings: Each unit has one vote. Annual meetings are held in January. A majority of unit owners present or by absentee ballot constitutes a quorum. Amendments to the declaration require 67% of votes; budget and rule changes require 51%. Owners delinquent in assessments lose voting rights.
- Common elements & maintenance: Common elements include land, pools, pavements, and utilities. The Board maintains them. Unit owners are responsible for interior utilities (plumbing, HVAC, etc.) and exterior maintenance of their own unit in a manner customary for single-family homes.
