What Darius Court Condominium Association's governing documents say
This is an amendment to the Declaration of Restrictions for Darius Court Condominium in Sun City, Arizona — a single-family condo community. The amendment, adopted in 2004, restricts rental of units, with grandfathering for owners who were already renting at that time.
- Rental ban with grandfathering: New rentals are prohibited. However, owners who were renting or leasing their unit as of March 3, 2004 (the adoption date) may continue to do so, provided they still own the unit and don't stop renting.
- When the right to rent ends: A grandfathered owner's right to continue renting terminates if: (1) the unit is sold, (2) the owner dies, or (3) the owner stops renting the unit. Once any of these events occurs, the unit cannot be rented by any future owner.
- Grandfathered rental units: Eight specific units were permitted to remain rental as of 2004: 10060 Royal Oak Road Units B, C, E, G, N, P, Q, and Thunderbird Boulevard units #10161 and #10173.
- Owner obligations: Owners with existing tenancies must provide the Board with documentation within 30 days of the amendment's adoption. Owners must also provide tenants and family members with current copies of the Declaration, By-Laws, and Rules.
- Family members vs. rentals: A unit occupied by family members of the owner (where those family members are not paying rent) is not treated as a rental tenancy and does not trigger rental restrictions.
